Terms of Service

1. Acceptance of Terms

By accessing and using CarList ("the Platform"), you accept and agree to be bound by the terms and provision of this agreement.

2. Eligibility

You must be at least 18 years old to use this Platform. By using CarList, you represent and warrant that you have the right, authority, and capacity to enter into this Agreement and to abide by all of the terms and conditions of this Agreement.

3. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Platform.

You are responsible for safeguarding the password that you use to access the Platform and for any activities or actions under your password.

4. Listing Rules

When creating a listing on CarList, you agree to:

• Provide accurate and truthful information about the vehicle
• Upload clear, recent photos of the actual vehicle
• Disclose any known issues or damages
• Price the vehicle fairly and competitively
• Respond to buyer inquiries in a timely manner

5. Payments and Fees

CarList charges fees for listing packages. All fees are stated in US Dollars and are non-refundable unless otherwise required by law.

You are responsible for paying all fees associated with using our service. We use third-party payment processors to handle all financial transactions.

6. Prohibited Activities

You may not use the Platform for any illegal or unauthorized purpose. Prohibited activities include but are not limited to:

• Posting fraudulent or misleading listings
• Harassing other users
• Violating any laws in your jurisdiction
• Uploading viruses or malicious code
• Spamming other users

7. Intellectual Property

The Platform and its original content, features, and functionality are and will remain the exclusive property of CarList and its licensors. The Platform is protected by copyright, trademark, and other laws of both the Kenya and foreign countries.

8. Liability Limitations

CarList acts as a platform to connect buyers and sellers. We are not involved in the actual transaction between buyers and sellers. We have no control over and do not guarantee the quality, safety or legality of items advertised.

9. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on this page.
